1. General Remarks
The following terms of sale apply to all products sold only through the e-commerce website www.noleti.ch. They set out the rights and obligations of both parties. Brasport SA reserves the right to modify the content and form of these terms of sale at any time.

2. Sales process
How to place an order
The customer selects an item for purchase and clicks on the “add to basket” button. The customer can then select further items, modify the contents of their basket, or proceed to payment.
All prices on the www.noleti.ch website are inclusive of Swiss value added tax (VAT) and are given in Swiss Francs (CHF). Items delivered outside Switzerland may be liable for Customs duty, taxes or other charges which are payable by the customer. Shipping and handling charges for deliveries within Switzerland are paid by Brasport SA.
Brasport SA reserves the right to modify, at any time and without notice, the prices and charges given on the e-commerce website. All items will be charged to the customer at the prices applicable at the time the order was confirmed.
Brasport SA will make every effort to ensure that product photographs on the www.noleti.ch website are as true to the actual product as possible. However, customers’ perception of the photographs may differ from the actual products.
Payment can be made by Visa, MasterCard or PayPal.
An order is considered valid after payment has been authorised by the financial institution.
In compliance with regulations, and to ensure the security and confidentiality of data, Brasport SA does not store customers’ bank details. For this reason, if the customer wishes to keep a record of their payment, they must save and print the payment confirmation.
3. Delivery and charges
Product prices include delivery charges for deliveries within Switzerland.
Products in stock are dispatched within five business days after authorisation of payment.
For payment by credit card, the amount is debited from the customer’s card when the transaction is confirmed.
Brasport SA will issue a refund in the following cases:
a) Brasport SA is unable to supply goods ordered by the customer.
b) Goods are returned to Brasport SA in compliance with our returns policy (below).
Brasport SA accepts returns if the product is defective or wrongly sized. Requests must be sent by email to firstname.lastname@example.org within three days of receiving the goods. All returns must be given prior approval. Full details (including returns address) are sent by email with the approval.
While Brasport SA makes every effort to ensure that its website is as accurate as possible, information is provided without warranty, either express or implied. Brasport SA does not guarantee the accuracy of the information given on its website and will not be held liable for any loss or damage resulting from the use of said information.
Under no circumstances will Brasport SA and/or its suppliers be held liable for any loss or damage resulting from the use of services or products distributed by www.noleti.ch.
7. Data protection
All personal data is considered to be confidential. Information required to fulfil the order will be processed and may be shared with third-party companies as required to complete the order.
Customer’s data may also be used by Brasport SA to:
• Send invitations by email informing the customer of sales and events;
• Strengthen and personalise communication with the customer, in particular by sending newsletters, special offers and other emails.
The customer can opt out of receiving invitation emails and other commercial communication from Brasport SA when creating their account and at any other time.
The customer must provide the personal information required to fulfil their order (delivery and billing). This information must be valid, accurate and up-to-date. The customer must not divulge their ID (logon) or password.

• modification to information subsequent to third-party fraudulent intrusion or hacking.
8. Intellectual property
Brasport SA retains exclusive intellectual property rights for the products sold.
9. Severability clause
If any provision of these terms of sale is held to be invalid or unenforceable, the validity and enforceability of the remaining provisions will not be affected. The parties will endeavour to replace the invalid or unenforceable provision by a valid provision whose commercial effect will be as close as possible to that of the invalid or unenforceable provision.
10. Applicable law and place of jurisdiction
• These terms of sale are governed by Swiss law.
• The courts at the registered office of Brasport SA have jurisdiction for any dispute or claim arising from the interpretation, non-performance and/or performance of the sale agreement.
